Background
Over the years Brian has been involved in litigating a wide variety of matters. These have included numerous medical malpractice suits, tort claims for personal injury (both on behalf of the Plaintiff and the Defence), suing and defending stock brokers and other professionals for negligence; litigating construction liens and commercial actions; as well as complex Estate Litigation cases.
Brian's trials have involved matters dealing with the Income Tax Act of Canada, the Competition Act, the Occupational Health and Safety Act and the Canada Shipping Act to name but a few. As well as all levels of Court, Mr. Banfield has appeared in front of a variety of administrative bodies including the OMB; the WSIB; the FSCO; the Liquor Control Board; and the Ontario Labour Relations Board.
As well as Court and Tribunal advocacy, Brian has represented individuals at Health Discipline Hearings and at Coroners Inquests. He has training in negotiation and mediation proceedings.
Brian has been involved in many cases that have been cited in the law reports. He has obtained Judgment of over 1 million dollars in one case alone and has been practicing for more than 25 years. Brian's focus is on obtaining the best results possible for his clients and often he has been able to achieve this without going to Trial.
